A boxer accused of murdering a soldier on a night out in Brecon is alleged to have told a woman he would rape her, a court has heard.
A jury at Cardiff Crown Court has been hearing the details of amateur boxer Jake Vallely’s night out in Brecon on Saturday, May 7 in the hours before a confrontation between him and soldier Matthew Boyd in Lion Street. Private Boyd, who was aged 20, died at hospital on May 8 after being found unconscious in Lion Street near Brecon Guildhall.
The prosecution said earlier in the evening Vallely had become involved in an argument with a woman at the Rorke’s Drift pub in Wheat Street.
He had been twice asked to leave the Rork’s Drift, after earlier being "loud and boisterous" around a group of men, described as hill walkers, according to bouncers who gave evidence. A bar maid from Harley’s nightclub also described Vallely as "on edge, angry and agitated" when he arrived. He was asked to leave after tearing a cocktail menu with his mouth.
The jury also saw CCTV footage, from the nearby Cellar Bar, where Vallely greeted soldier Mr Boyd at the bar. Private Boyd, who lived in Gibraltar, and Vallely, of Pen y Bryn, Brecon, were unknown to each other but the 24-year-old defendant greeted the off-duty soldier, who was also on a night out in Brecon, with a fist bump.
However shortly afterwards there was an incident between Vallely and Pte Boyd outside the bar, in Lion Street, which ended with Mr Boyd falling to the ground in what prosecutor Chris Quinlan called a "violent, sensless attack that caused that young man’s death."
Vallely, his friend Aaeron Evans, 23 of Cradoc Close, Brecon who is standing trial for manslaughter, and a third man Kyle O’Shea, were seen on CCTV arriving at the Cellar Bar just after midnight.
The friends had been out since earlier that Saturday, at Harley’s bar, where Vallely, was ejected by the bouncers, and earlier at the Rorke’s Drift where Valley had also been asked to leave after an argument with a woman, Kelly Price.
Miss Price told the jury she had arrived at the Rorke’s Drift separately, but at the same, as Vallely – who she didn’t know "personally" - and his friends. After a short while she went to join the mixed group at a booth they were sitting at to talk to Mr O’Shea, who she only knew by his surname.
However she said Vallely was aggressive towards her when she sat down. Miss Price told the jury: "He said, ’who the f*** do you think you are, sitting with us?’ He was aggressive, he kind of got up out of his chair and leaned over Kyle O’Shea, to lean over to me and was really shouting at me. I was sat.
"I said ’it doesn’t matter who I am, who are you?’ That’s when he said I’m Kyle O’Shea, which I knew was a lie as I was sat with him (O’Shea). That’s when I said ’I know that’s not true, why are you lying?’
"That’s when he said to me. I don’t know in which order it was, ’you’re a f****** heifer. I’ve raped worse than you. I’ll rape you. I’m the hardest man in Brecon."
Miss Price said both eventually stood up and she pushed Vallely to his chest and told him to ’f*** off’. She said she had been asking why he had said the "stupid" thing. Bouncers then removed Vallely from the pub.
She said: "I think it hit me then and I started crying and I ran to the back so no-one could see me. I was a bit emotional. Everything he said, the heifer, that he would rape me and the swear words. I felt intimidated but I didn’t want to show it."
Miss Price said she left the pub shortly afterwards and again saw Vallely at the Brecon Kebab House, in the High Street, and she thought he was "smirking" at her and trying to "taunt her". She said she asked Vallely why he had said he would rape her, but he repeatedly denied it.
She added: "I said just admit it. It doesn’t matter just admit you said it. He started swearing again. I think he called me a f****** slag and some other swear words. Kyle O’Shea tried to calm him down."
Miss Price said Vallely then had a conversation with her friend Robert Wearing, who had also left the pub, and she challenged Vallely: "I said ’how would my boyfriend feel if he knew you said you’d like to rape me?’ He said ’who’s your f****** boyfriend? I’ll kill him, I’m the hardest man in Brecon
Eventually she said Vallely accepted he’d made the comments but hadn’t meant them. She said: "He said ’OK I did say it, I was just showing off in front of my friends."
Asked by Mr Quinlan what was Vallely’s demeanour when he apolgised Miss Price replied: "He didn’t really care."
Miss Price said she then went to Harley’s with Evans and Mr O’Shea and Vallely, who had been asking his friends why they had "chosen" her over him, agreed to pay for them all to enter the club.
Peter Rouch, defending Vallely, said he had "never" used the word "heifer" but said Miss Price may have "misheard" it and also said she had misunderstood the comment about rape.
Miss Price agreed with Mr Rouch that nobody in the group Vallely was with was "shocked or bothered" when he asked her who she was and why she was sitting with the group.
He also asked why she hadn’t left the booth if she felt uncomfortable. She agreed she could have at any time but said she didn’t want to as she didn’t want to show she could be intimidated.
Asked by Vince Coughlin, representing Evans, if there was "anything confrontational" about his behaviour she replied: "Not at all."
When Mr Wearing gave evidence he said Miss Price had told Vallely, outside the kebab house, "If my boyfriend was here he would have hit you by now."
Asked by Mr Quinlan what was Vallely’s reply, Mr Wearing answered: "He said ’who is your boyfriend? I’ll f****** kill him’. I said her boyfriend is my business partner, he looked pretty shocked. He was very apologetic and kept saying I’m sorry, I’m sorry I didn’t mean that."
Mr Wearing said one of Vallely’s friends said he was drunk and they had been looking after him and Vallely said: "I was just acting big infront of my mates, I didn’t mean it."
Vallely denies murder and Evans denies manslaughter and the trial continues.
