A proposal has been lodged with Bannau Brycheiniog National Park Authority (BBNPA) planners to knock two flats together in Brecon, so they become a four-bedroom supported living apartment.
First Choice Housing Association has lodged certificates of lawful proposed use or development applications with BBNPA for flats seven and eight, Court View, Hoggan Park.
If agreed, the work can go ahead without a full planning application being needed.
Planning agents Asbri Planning Limited said: “The application site comprises flats seven and eight, situated on the second floor of a three-storey block of apartments at Court View, Hoggan Park, Brecon.
“At present, the application site comprises a pair of two-bedroom apartments located on the second-floor level.
“These proposals relate wholly to internal works in order to achieve the amalgamation and reconfiguration of the existing two apartments.
“The proposals will not result in any exterior alterations to the form of the host property.
“The proposed four-bedroom supported living apartment will remain under Use Class C3 dwelling houses.”
Asbri Planning believe that a change of use “will not occur as a result of these proposals.”
It continued: “From a procedural perspective, a local planning authority needs to consider whether, on the facts of the case and relevant planning law, the specific matter is or would be lawful.
“Planning merits are not relevant at any stage in this particular application.
“This application is to formally establish that the works proposed are ‘lawful’, in that no planning permission is required and no enforcement action may be taken.”
The development would be considered lawful if it does not fall within the definition of development as explained in Section 55 of the Town and Country Planning Act 1990.
If the proposal passes this test, it would not be deemed to be “operational development”.
